The Witness
Witnesses can be subpoenaed to testify in court by
the prosecution or defense. A witness is required to honor a subpoena when properly served
and must appear and testify unless released by a judge. A witness is placed
under oath before testifying and false testimony could lead to a charge
of perjury.
A criminal defendant, with a few exceptions, has the constitutional
right to confront witnesses against him in open court where his attorney
can conduct full cross examination.
